Governor Crist to sign Barwick-Ruschak Act Bill will provide more latitude to law enforcement and victims of
domestic violence
Ocala, FL— On Tuesday, July 2, Governor Charlie Crist will sign into law HB
313, the “Barwick/ Ruschak Act.” The legislation, which provides greater latitude in cases of dating
violence, was sponsored in the Florida Senate by Senator Charlie Dean and in the Florida House by
Representative Kurt Kelly.
The “Barwick- Ruschak Act” expands the definition of domestic violence to include victims in dating
relationships. This will include assisting victims with medical treatment, informing them of local
domestic violence centers and providing victims with information outlining their legal rights and
remedies. The bill also strengthens law enforcement officers practice of filing a written report in
dating violence cases. Furthermore, HB 313 enables law enforcement officers to make a warrantless
arrest when there is probable cause to believe a person has committed an act of dating violence.
“The story of Tiffany Barwick and Michael Ruschak is a senseless tragedy. This bill will give our law
enforcement officers more latitude to handle threats of domestic violence,” said Senator Dean. “It will
also fortify the rights of the victims of domestic violence and provides to them remedies and services
when they are suspected victims. It was an honor to work on behalf of the Barwick family, the Ruschak
family and indeed all victims of dating violence and domestic violence with this good bill.”
